NSW operating requirements waiver

Under section 27 of the Electronic Conveyancing National Law, the Registrar General may waive compliance with all or any provisions of the NSW Operating Requirements if the Registrar General considers it appropriate in the circumstances.

Current waivers

  • NSW Operating Requirements Waiver OR3 2019

    Provides Sympli with conditional relief from the NSW Operating Requirements to publish a set of Integration terms and conditions for individuals or entities that wish to integrate their systems with the ELN.

  • NSW Operating Requirements Waiver OR2 2019

    Provides PEXA with conditional relief from the NSW Operating Requirements in relation to separation of Downstream or Upstream Services, including preparing a Separation Plan.

  • NSW Operating Requirements Waiver OR1 2019

    Provides PEXA with conditional relief from the NSW Operating Requirements to publish a set of Integration terms and conditions and to treat individuals or entities that wish to integrate their systems with the ELN on an equivalent basis.

Historical waivers

  • NSW Operating Requirements Waiver OR4 2015

    Provides relief for ELNOs from the NSW Operating Requirement to apply the Subscriber Identity Verification Standard in the Operating Requirements applying at the time if the Standard in Version 3 of the Operating Requirements was applied.

  • NSW Operating Requirements Waiver OR3 2015

    Provides relief for ELNOs from the NSW Operating Requirement to appoint an Independent Expert that is not an existing contractor to the ELNO.

  • NSW Operating Requirements Waiver OR2 2015

    Provides ELNOs with relief from the NSW Operating Requirement to enforce Subscriber compliance with the NSW Participation Rule requiring identity verification of mortgagors at or before signing of the mortgage.

  • NSW Operating Requirements Waiver OR1 2015

    Provides ELNOs with relief from the NSW Operating Requirement to use an ELNO Agent with uncapped insurance cover for Subscriber identity verifications.
