From 27 April 2020, changes to the Conveyancing Rules temporarily allowed paper land dealings, plans and section 88B instruments to be signed electronically. These rules have now been incorporated in the Conveyancing Rules – (COVID-19 Pandemic) Amendment (Version 2), which was published on 21 December 2021 and continues to be in force. This amendment indefinitely extends the electronic signing provisions.

These documents may also be witnessed electronically using an audio-visual link under Part 2B of the Electronic Transactions Act 2000.

These provisions do not alter any existing requirements for execution and certification, verification of identity or establishing the right to deal.

Please refer to the Guidance Note on executing NSW plans for more information about signing and witnessing plans.

Please note: The Registrar General has declared under the NSW Conveyancing Rules that all land dealings must be lodged electronically by a Subscriber to an Electronic Lodgment Network (ELN). Lodging land dealings in paper will not be permitted from 11 October 2021.

ARNECC has provided guidance on conducting eConveyancing during this time.
