New Community Land Development Regulation 2018 to commence on 1 September 2018

The Community Land Development Regulation 2007 will be repealed and remade on 1 September 2018 as the Community Land Development Regulation 2018 (Regulation).

The Regulation has been amended for internal consistency and to simplify its structure and readability, and does not introduce any significant regulatory changes. The following minor changes have been made:

  • The structure of the Regulation has been simplified, combining the requirements for community plans, precinct plans and neighbourhood plans together. This restructure has removed internal inconsistencies and made the Regulation easier to navigate.
  • The Land and Property Information NSW (Authorised Transaction) Act 2016(LPI Transaction Act) made amendments to the Real Property Act 1900, Conveyancing Act 1919 and other associated legislation so that all references to lodging instruments “in the office of the Registrar General” were amended to “with the Registrar General”. Those references have been updated in the Regulation for clarity and consistency.
  • The LPI Transaction Act introduced “Lodgment Rules”, which deal with the preparation, form and content of registry documents, as well as other procedural matters. Amendment has been made in the Regulation to reference the Lodgment Rules where appropriate.
  • Other minor updates relating to changes in terminology brought about by legislative amendment have been made in the Regulation. This includes removing references to the repealed Surveying and Spatial Information Regulation 2017 and soon to be repealed Conveyancing (General) Regulation 2013.
