Notifications

There are a number of instances within the strata renewal process requiring notification to be made to the Registrar General:

Notice where Required Level of Support has been obtained – section 176

Where the secretary of the owners corporation has been notified that the required level of support for a Strata Renewal Plan has been obtained, the secretary must, within 14 days after receiving that notice, give written notice to the Registrar General.

Notice to the Registrar General may be given by lodging a Form 11R Request with NSW Land Registry Services.

On receiving the notice, the Registrar General will enter the following notification on the folio for the Common Property:

“This strata scheme is the subject of a strata renewal plan for which the required level of support has been received – see section 176 Strata Schemes Development Act 2015

Notice of lapsing of a Strata Renewal Plan affecting a Strata Renewal Scheme - section 177

Where a Strata Renewal Plan lapses in the circumstances set out in section 177, the owners corporation must, as soon as practicable give written notice to the Registrar General.

Notice to the Registrar General may be given by lodging a Form 11R Request with NSW Land Registry Services.

On receiving the notice, the Registrar General will enter the following notification on the folio for the Common Property:

“This strata scheme is no longer the subject of the strata renewal plan (see s 177 Strata Schemes Development Act 2015) which lapsed on DD/MM/YYYY”

Notice of Order of Land and Environment Court giving effect to a Strata Renewal Plan - section 183

Where the Land and Environment Court makes an Order giving effect to a Strata Renewal Plan, the owners corporation must lodge the Order for registration with the Registrar General within 7 days of the Order having been made.

Notice to the Registrar General may be given by lodging a Form 11R Request with NSW Land Registry Services.

On receiving the notice, the Registrar General will enter the following notification on the folio for the Common Property and for each lot in the strata scheme:

“Order of Court giving effect to strata renewal plan – section 183 Strata Schemes Development Act 2015"

Notice of Termination of Strata Scheme – sections 184 and 185

On termination of a strata scheme, the Purchaser (where the Strata Renewal Plan relates to a collective sale) or the Developer (where the Strata Renewal Plan relates to a redevelopment) must give the Registrar General notice of the termination in the approved form.
