New community title laws approved by Parliament

The Community Land Development Act 2021 and Community Land Management Act 2021 have now received assent, after passing the NSW Parliament on 16 March 2021.

The laws can be viewed on the NSW Legislation website and are expected to commence before the end of 2021, once supporting regulations have been developed.

The reforms align community schemes laws with strata schemes laws, including changes made in the 2015 major strata reforms and other changes since then.  The new community schemes laws provide more modern, flexible and democratic governance arrangements for developers, residents and commercial occupants of community lands.

The Office of the Registrar General and NSW Fair Trading are currently developing new proposed Regulations which will be released, together with a Regulatory Impact Statement, for public comment shortly.
