New licence conditions applying to Electronic Lodgment Network Operators

On 1 February 2019, the Office of Registrar General (ORG) published new licence conditions applying to Electronic Lodgment Network Operators (ELNO). The conditions will take effect from 1 March 2019.

Previously, NSW’s arrangements with ELNOs comprised an operating agreement between the Registrar General and the ELNO. However, NSW has now adopted a ‘licence with conditions’ approach, consistent with that taken in other regulated markets, such as telecommunications and energy. It ensures consistent regulation of all market entrants, while also permitting the Registrar General to include additional conditions where appropriate in the market.

The conditions are the result of an extensive consultation among ELNOs, applicant ELNOs and other stakeholders, such as NSW Land Registry Services, the Law Society and the ACCC. ORG thanks all who participated in the consultation process.
