Strata Legislation Amendment Bill 2023 passes in NSW Parliament

The Strata Legislation Amendment Bill 2023 passed Parliament on 22 November 2023. The Bill, which commences on assent, will implement 31 recommendations from the 2021 Report on the statutory review of the strata laws, marking the first phase of reforms that will give immediate benefits to people living in strata.
The legislation amends the Strata Schemes Development Act 2015 and Strata Schemes Management Act 2015 to:
- make the strata collective sale and renewal process more transparent by ensuring owners must disclose conflicts of interest and clarifying that the court can award costs against those acting unreasonably,
- make it easier and fairer for residents to keep pets by banning fees, bonds or insurance as a condition of having a pet,
- dispense with the need to value all lots in the scheme for a strata plan of subdivision involving common property, if changes to common property are minor and do not impact the proportionate unit entitlement, and
- ensure goods and services are obtained at competitive prices by requiring that owners corporations obtain two quotes from unrelated providers for works to common property exceeding $30,000 in value.
